OurWay Terms of Service

1. About OurWay

OurWay is a technology platform designed to connect customers with transporters for transportation and parcel services.

OurWay may provide technology that allows users to request rides, arrange transportation, communicate relevant service information, and facilitate parcel transportation.

Unless expressly stated otherwise, OurWay operates as a platform connecting users and transporters and is not necessarily the direct provider of every transportation service arranged through the platform.

2. Eligibility

You must provide accurate information when creating and maintaining an OurWay account.

You are responsible for ensuring that you are legally permitted to use OurWay and its services under the laws applicable to you.

Users must not create accounts using false identities or misleading information.

OurWay may restrict, suspend, or terminate accounts where information is fraudulent, misleading, abusive, or otherwise violates these Terms.

3. Your Account

You are responsible for:

• Providing accurate account information
• Keeping your account information up to date
• Protecting access to your account
• Keeping authentication information secure
• Not allowing unauthorized persons to use your account
• Not impersonating another person

You should contact OurWay promptly if you believe your account has been compromised.

4. Google Sign-In

OurWay may allow users to register or sign in using Google.

When using Google Sign-In, you must comply with Google's applicable terms and policies.

OurWay does not receive your Google password.

Your use of Google authentication remains subject to Google's own terms and policies in addition to these OurWay Terms.

5. Customer Responsibilities

Customers using OurWay agree to:

• Provide accurate pickup and destination information
• Provide accurate contact information
• Be available at the agreed pickup location
• Treat transporters respectfully
• Follow applicable safety requirements
• Provide accurate information about parcels
• Not use OurWay for unlawful purposes
• Not intentionally misuse or abuse the platform

Customers should not request transport of illegal, dangerous, prohibited, or improperly packaged items.

6. Transporter Responsibilities

Transporters using OurWay agree to:

• Provide accurate personal and transportation information
• Maintain an accurate transporter profile
• Provide truthful information during any verification or approval process
• Operate in compliance with applicable laws
• Maintain any licenses, permits, insurance, or authorizations required for their transportation activities
• Treat customers respectfully
• Handle parcels with reasonable care
• Maintain safe transportation practices
• Keep their availability status reasonably accurate
• Not misuse customer information

Transporters are responsible for complying with all laws and requirements applicable to their transportation activities.

7. Rides

OurWay may allow customers to request rides and transporters to accept those requests.

Ride availability, pricing, estimated arrival times, routes, and other service information may change based on availability, location, traffic, weather, transporter activity, technical conditions, or other factors.

A ride request does not necessarily guarantee that a transporter will accept the request unless the platform explicitly confirms the ride.

Users should rely on the information displayed by OurWay for the current status of their ride.

8. Parcels

OurWay may allow customers to arrange transportation of parcels through transporters.

Customers are responsible for accurately describing and appropriately packaging parcels.

Users must not use OurWay to transport items that are illegal, dangerous, prohibited, hazardous, stolen, or otherwise unsuitable for transportation.

OurWay may refuse or cancel transportation of a parcel where we reasonably believe that the parcel violates these Terms, applicable law, or safety requirements.

9. Prohibited Activities

You must not use OurWay to:

• Commit or facilitate illegal activity
• Defraud or deceive other users
• Impersonate another person
• Harass, threaten, or abuse users
• Circumvent platform security
• Gain unauthorized access to accounts or systems
• Interfere with the operation of OurWay
• Upload malicious software or harmful content
• Submit intentionally false information
• Abuse referral, reward, promotional, or other platform systems
• Use the platform to transport prohibited items
• Collect or misuse personal information belonging to other users
• Attempt to reverse engineer or exploit the platform

OurWay may take appropriate action against accounts involved in prohibited activities.

10. Payments and Charges

Where OurWay provides payment or pricing functionality, applicable prices, fees, charges, or payment information will be displayed through the platform where reasonably possible.

Users are responsible for paying applicable charges associated with services they request.

Prices or charges may change from time to time.

Where a payment provider is used, payment processing may also be subject to that provider's terms and policies.

11. Cancellations and Service Issues

A ride or parcel request may be cancelled by a customer, transporter, or OurWay depending on the circumstances.

Cancellation rules, applicable charges, and refund policies may depend on the service and circumstances and may be communicated through the platform.

If you experience a problem with a ride, transporter, parcel, payment, or other service, you should report it to OurWay as soon as reasonably possible.

12. Safety

Users are expected to exercise reasonable judgment and caution when using transportation services.

Customers should verify the identity and relevant details of their transporter before entering a vehicle or handing over a parcel.

Transporters should verify relevant customer and parcel information before accepting or completing a service.

If you believe you are in immediate danger, contact the appropriate emergency services in your location.

OurWay may take action when conduct presents a safety risk to users or the platform.

13. User Content and Profiles

Users may provide profile photos, descriptions, names, and other information through OurWay.

You are responsible for ensuring that information you provide is accurate and that you have the right to provide any content you upload.

You must not upload content that is unlawful, deceptive, abusive, threatening, discriminatory, sexually explicit, infringing, or otherwise inappropriate for the platform.

OurWay may remove content or restrict accounts where necessary to protect users, enforce these Terms, or comply with applicable law.

14. Intellectual Property

The OurWay name, branding, logos, software, interface, design, and other original materials associated with the platform are owned by or licensed to OurWay unless otherwise stated.

You may use the platform for its intended purpose, but you may not copy, reproduce, modify, distribute, sell, or exploit OurWay's intellectual property without appropriate authorization.

15. Third-Party Services

OurWay may rely on third-party services for functions such as authentication, hosting, maps, communications, payments, analytics, and other technology services.

Third-party services may have their own terms and privacy policies.

OurWay is not responsible for independent third-party services that are outside OurWay's reasonable control.

16. Availability of the Service

We aim to keep OurWay available and reliable, but we do not guarantee that the platform will always be available, uninterrupted, error-free, or free from technical problems.

Services may occasionally be unavailable because of maintenance, technical failures, network problems, third-party service interruptions, security events, or circumstances outside our reasonable control.

17. Suspension and Termination

OurWay may suspend, restrict, or terminate an account where reasonably necessary, including where a user:

• Violates these Terms
• Provides false information
• Engages in fraud or abuse
• Creates a safety risk
• Misuses the platform
• Attempts unauthorized access
• Violates applicable law

Users may stop using OurWay at any time.

Termination does not necessarily eliminate obligations or rights that arose before termination.

18. Disclaimer

OurWay provides a technology platform intended to facilitate transportation and parcel services.

To the extent permitted by applicable law, OurWay does not guarantee the conduct, availability, punctuality, safety, quality, or performance of independent users or transporters.

Users are responsible for exercising reasonable judgment when using the platform and services.

Nothing in these Terms is intended to exclude rights or protections that cannot legally be excluded.

19. Limitation of Liability

To the extent permitted by applicable law, OurWay will not be responsible for indirect, incidental, consequential, or unforeseeable losses arising from the use of the platform or services.

Nothing in these Terms excludes liability where such exclusion is prohibited by applicable law.

20. Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims, losses, damages, liabilities, and reasonable expenses arising from your unlawful use of OurWay, your violation of these Terms, or your misuse of the platform.

21. Changes to These Terms

We may update these Terms from time to time.

When material changes are made, we may provide notice through the platform or other appropriate means.

Continued use of OurWay after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

22. Governing Law

These Terms are intended to operate in accordance with the laws applicable to the operation and use of OurWay.

Where legally applicable, disputes will be handled according to the jurisdiction and legal procedures applicable to the relevant parties.
